OVERVIEW

This website is operated by Your Musa LLC, a Florida limited-liability company ("Your Musa," "we," "us," or "our"). Throughout the site, the terms refer to Your Musa as the provider of this website, including all information, tools, and services available to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated herein (collectively, these "Terms").

By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by these Terms, including any additional terms referenced herein or available by hyperlink (such as our Refund & Exchange Policy, Privacy Policy, and SMS Terms). These Terms apply to all users of the site.

If you do not agree to all the Terms, do not access or use the Service.

SECTION 1 – ONLINE STORE TERMS

You represent that you are at least the age of majority in your jurisdiction (or have given us consent for any minors to use this site). You may not use our products for any illegal purpose or to violate any laws—including intellectual-property laws—or transmit malicious code. Any violation will result in immediate termination of Service.

SECTION 2 – GENERAL CONDITIONS

We reserve the right to refuse Service to anyone at any time. Your content (excluding payment information) may be transferred unencrypted across networks; credit-card data is always encrypted. You may not reproduce, duplicate, sell, resell, or exploit any portion of the Service without our express written permission.

SECTION 3 – ACCURACY OF INFORMATION

We are not responsible if information on this site is inaccurate, incomplete, or out-of-date. Any reliance on such material is at your own risk. We are under no obligation to update content except as required by law.

SECTION 4 – MODIFICATIONS TO THE SERVICE & PRICING

Prices, product descriptions, and availability are subject to change without notice. We may modify or discontinue any Service at any time without liability to you.

SECTION 5 – PRODUCTS & SERVICES

Some products or services may be available exclusively online and in limited quantities. All returns are governed by our Refund & Exchange Policy. Colors and images may vary by monitor. We reserve the right to limit quantities or refuse sales at our sole discretion. We do not warrant that any product or Service will meet your expectations or that errors will be corrected.

SECTION 6 – ORDER, BILLING & SHIPPING

We reserve the right to refuse or cancel any order. If we do so, we will attempt to notify you via the contact information provided. You agree to supply current, complete, and accurate purchase and account information.

Shipping & Risk of Loss: Orders ship pursuant to our Shipping Policy. Title and risk of loss pass to you upon delivery to the carrier. We are not liable for carrier delays. International buyers are responsible for duties and taxes.

SECTION 7 – RETURNS & REFUNDS

All returns are governed by our Refund & Exchange Policy (available at https://yourmusa.com/refund-policy). Items must be unused, in original condition, and returned within the stated window. We may deny refunds that do not meet policy requirements. Unless otherwise stated, return shipping costs are your responsibility.

SECTION 8 – THIRD-PARTY SERVICES & TOOLS

We may provide you with access to, or our site may integrate, third-party services including but not limited to Klaviyo (email/SMS marketing), Meta (Facebook/Instagram), Pinterest, Google Analytics 4, and Microsoft Clarity (collectively, "Third-Party Services"). We provide access "as is" without warranties of any kind and without endorsement. Your use of Third-Party Services is governed solely by the applicable third-party terms, and we have no liability arising from your use of them.

SECTION 9 – THIRD-PARTY LINKS

Certain content, products, and services available via our Service may include materials from third parties. We are not responsible for examining or evaluating their content or accuracy and do not warrant or assume liability for any third-party materials, websites, or services.

SECTION 10 – USER SUBMISSIONS

Any comments, feedback, or other content you send us (collectively, "Submissions") may be used by us without restriction. You are solely responsible for your Submissions and must ensure they do not infringe third-party rights.

SECTION 11 – PERSONAL INFORMATION & PRIVACY

Your submission of personal information through the store is governed by our Privacy Policy, which explains how we collect, use, and share data—including through the Third-Party Services listed in Section 8—and provides disclosures required under the Florida Information Protection Act (FIPA), the California Consumer Privacy Rights Act (CPRA), and the EU GDPR for international customers.

SECTION 12 – SMS MARKETING TERMS (TCPA COMPLIANCE)

By opting in to receive SMS messages from us (e.g., via Klaviyo forms or at checkout), you consent to receive marketing text messages (e.g., cart reminders) at the phone number provided. Consent is not a condition of purchase. Message frequency varies. Standard message & data rates may apply. Reply STOP to cancel, HELP for help. For more information, see our SMS Terms (https://yourmusa.com/sms-terms).

SECTION 13 – ELECTRONIC COMMUNICATIONS & ESIGN ACT

You consent to receive communications from us electronically (e-mail, SMS, site notices) and agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

SECTION 14 – ADA ACCESSIBILITY STATEMENT

Your Musa is committed to making its website accessible to individuals with disabilities. We strive to meet or exceed the Web Content Accessibility Guidelines (WCAG) 2.1. Violation may result in immediate termination of access and potential legal action.

SECTION 17 – INTELLECTUAL PROPERTY

All content on this site—including product designs, images, logos, text, and graphics—is the exclusive property of Your Musa LLC or its licensors and is protected by U.S. and international copyright, trademark, and other laws. Any reproduction or use without prior written consent is strictly prohibited.

SECTION 18 – DMCA NOTICE & TAKEDOWN PROCEDURE

If you believe that material residing on or accessible through the Service infringes your copyright, please send a notice (per 17 U.S.C. §512) to our Designated DMCA Agent:

SECTION 19 – DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY

Our products and Services are provided “as is” and “as available,” without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free.

To the fullest extent permitted by Florida law, Your Musa LLC shall not be liable for any direct, indirect, incidental, punitive, special, or consequential damages of any kind—including, without limitation, lost profits, lost revenue, lost savings, loss of data, or replacement costs—arising from your use of any Service or product.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages; in such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

SECTION 20 – INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Your Musa LLC, its officers, directors, employees, affiliates, agents, contractors, licensors, service providers, and suppliers from any claim or demand (including reasonable attorneys’ fees) arising out of your breach of these Terms or your violation of any law or the rights of a third party.

SECTION 21 – DISPUTE RESOLUTION, ARBITRATION & CLASS ACTION WAIVER

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR RIGHTS.

  1. Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The place of arbitration shall be St. Petersburg, Florida, and judgment on the award rendered may be entered in any court having jurisdiction.

  2. Class Action Waiver. You and Your Musa agree that any proceedings shall be conducted only on an individual basis and not in a class, consolidated, or representative action.

  3. Small‑Claims Option. Either party may elect to pursue a claim in small‑claims court in Pinellas County, Florida, instead of arbitration, provided the claim qualifies under applicable rules.

  4. 30‑Day Right to Opt Out. You may opt out of this arbitration agreement by sending written notice to info@yourmusa.com or the postal address in Section 28 within 30 days of your first use of the Service. If you do not opt out, you waive the right to a jury trial and to participate in a class action.

SECTION 22 – SEVERABILITY

If any provision of these Terms is held unlawful, void, or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed; such determination shall not affect the validity and enforceability of any remaining provisions.

SECTION 23 – TERMINATION

These Terms are effective unless and until terminated by either you or us. You may terminate at any time by notifying us that you no longer wish to use our Services or by ceasing to use our site. We may terminate this agreement at any time without notice if you violate any provision of these Terms.

SECTION 24 – ENTIRE AGREEMENT

These Terms and any policies or operating rules posted by us constitute the entire agreement between you and us and govern your use of the Service, superseding any prior or contemporaneous communications, proposals, or agreements (whether oral or written).

SECTION 25 – GOVERNING LAW

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Florida, USA, without regard to its conflict‑of‑law principles.

SECTION 26 – FORCE MAJEURE

We are not liable for any failure to perform or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, governmental actions, labor disputes, or supply‑chain disruptions. Our obligations are suspended for the duration of the event, and we will notify you within a reasonable time of becoming aware of such event.

SECTION 27 – CHANGES TO TERMS

We may revise these Terms at any time by posting the updated version on this page and updating the "Last updated" date above. It is your responsibility to review these Terms periodically. Your continued use of the Service following the posting of changes constitutes acceptance of those changes.
